Terms of Service

These Terms of Service ("Terms") govern the moving and related services provided by Kometa Moving LLC ("Kometa Moving," "we," "us," or "our") and your use of our website. By requesting a quote, booking a move, or using our services, you agree to these Terms.

1. About Us

Kometa Moving LLC is a family-owned household moving company based at 13409 Midland Rd, Poway, CA 92064, serving San Diego County and surrounding areas. We are a licensed and insured California household mover, regulated by the California Bureau of Household Goods and Services (BHGS), license CAL-T # 201997.

2. Services

We provide local residential and commercial moving services, including loading, transportation, unloading, and related labor. The specific services for your move are described in your written Estimate and Agreement.

3. Estimates and Agreements

Before your move, we provide a written Estimate and Agreement describing the services and charges. For applicable moves we provide a "Not-To-Exceed Price," and we will not charge more than that price unless you add items or request services that were not included in your original Agreement. A verbal price quote is not a binding estimate. All rates and charges comply with applicable BHGS requirements and our published rate schedule (tariff).

4. Local Moves and Double Drive Time

For local moves, charges are based on our hourly rate applied to the time spent loading, unloading, and driving between your origin and destination. As required by California's Maximum Rate Tariff (Max 4) for all licensed household movers, the driving time between the origin and the destination is doubled ("Double Drive Time") and billed at the hourly rate. We do not charge you for the time it takes to travel from our location to your origin, or to return after your move — only the doubled origin-to-destination drive time is billed. Certain moves (for example, those requiring multiple trips or split pickup and delivery) are billed according to the applicable provisions of the Max 4 Tariff.

5. Changes and Added Services (Change Orders)

If you add items, request additional services, or conditions at the location differ from what was described (for example, additional flights of stairs, long carries, or heavy/specialty items such as pianos or safes), additional charges may apply. Any such charges will be documented in a written Change Order with the projected total before the additional work is performed.

6. Bulky, Heavy, and Specialty Items

Some items are oversized, heavy (generally over 250 lbs), or require special handling, equipment, or additional crew — for example, pianos, safes, gun safes, pool tables, hot tubs, large or commercial appliances, and exercise equipment. You agree to disclose all such bulky, heavy, or specialty items when requesting your quote so we can plan and price your move accurately.

A flat handling fee may apply to bulky, heavy, or specialty items. Any such fee will be disclosed to you in advance — in your written Estimate, or, if the item is identified at the time of the move, in a written Change Order before the additional work is performed, consistent with your Not-To-Exceed Price. We may decline to handle any item that cannot be moved safely or that requires equipment or conditions beyond the scope of your Agreement.

7. Customer Responsibilities

  • Provide accurate information about the inventory, access, parking, stairs, and elevators at both locations.
  • Ensure clear and safe access for our crew and equipment.
  • Do not tender hazardous, perishable, illegal, or prohibited materials (for example, flammables, corrosives, explosives, combustibles, or live animals). We may decline to transport such items.
  • Remove or separately transport irreplaceable documents, currency, jewelry, and high-value items unless special arrangements are made in writing.

8. Deposit and Booking

A $100 deposit is required to reserve your moving date. The deposit is applied toward your final invoice. If you cancel or reschedule at least 48 hours before your scheduled move, your deposit is fully refundable. Cancellations or reschedules made less than 48 hours before the scheduled move forfeit the deposit. The remaining balance is due upon completion of the move.

9. Payment

Payment is due as stated in your Agreement. Accepted payment methods will be provided at booking. We do not demand payment beyond the amounts disclosed in your written Estimate or Agreement to release your goods.

10. Cancellation and Rescheduling

If you need to cancel or reschedule, please contact us as soon as possible. Deposit refunds follow the Deposit and Booking section above. Any additional cancellation or rescheduling terms are described in your Agreement.

11. Valuation and Liability for Goods

Your goods are covered according to the valuation option selected in your Agreement, as permitted under California household mover regulations. Released value and any optional higher-valuation coverage, along with applicable limits, are described in your Agreement. Please review your valuation options carefully before your move.

12. Claims

If loss or damage occurs, you must notify us in accordance with the claims procedures described in your Agreement and applicable BHGS regulations. We will work with you in good faith to resolve valid claims promptly.

13. Insurance

Kometa Moving LLC maintains insurance as required for licensed California household movers, including cargo and auto liability coverage. Proof of coverage is available upon request.

14. Limitation of Liability

To the maximum extent permitted by applicable law and our regulatory obligations as a licensed mover, our liability for any claim arising out of our services is limited to the valuation coverage selected in your Agreement. We are not liable for indirect, incidental, or consequential damages.

15. Regulatory Information

As a California household mover, our operations are regulated by the Bureau of Household Goods and Services (BHGS). California law provides important protections to consumers moving household goods. We provide the BHGS publication "Important Information for Persons Moving Household Goods (within California)" as required.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be subject to the applicable rules and venue under California law.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
